My husband just recently got a DUI in Virginia. He passed all of the field tests, but blew a .21 in the breathalyzer. The officer told him that he could not use the breathalyzer outcome in court. Should he get an attorney, or do it on his own. We don’t have much money, we have a baby due in one week and I don’t want him to do more than 2 weeks in jail…. please help

Where I am .08 is the limit. I would definitely suggest an attorney in this case. It would be worth the cost.

Of all states, Virginia! Ouch!
Considering he is facing a MINUMIM of 10days jail, and could face up to a year, yes, get an attorney.
